Khaitan & Co advised the client regarding filing of a suit before the High Court of Delhi, inter alia, seeking relief in relation to a Will executed by client's late father and the deceased's estate. The Will is the last declaration of the intention of the client’s father with respect to his properties, both movable and immovable, through which bequests have been made in favour of the client. The suit has been filed effectively for giving effect and enforcement of the said Will. Along with the suit, interim reliefs were also sought from the Court, including temporary injunctions, and appointment of a local commissioner.
The Court after hearing submissions on behalf of the Parties at length, was pleased to issue notice. The Court further granted temporary injunctions restraining the Defendant, her agents, nominees, employees, representatives or any other person acting under the authority of the defendant are restrained from, in any manner, alienating, transferring, assigning, conveying, selling, encumbering or creating third-party interests, in immovable or movable properties. Additionally, the Court also allowed the prayer for inspection of a property at Golf Links for preparing an inventory of painting being of high value and exclusive in nature.
